billiejeanjacksonUPDATE In an exclusive interview, Billie Jean Jackson just told OK!: “I am the mother of Blanket. I have two older children but he’s mine.

“I missed the custody hearing last week because Katherine [Jackson] had me arrested. I was incarcerated for a week and I missed the hearing because I was looking for transitional housing,” she said.

“I also want to contest the two wills. I want forensic testing of the signatures which were faked by Katherine Jackson and John Branca. Those wills are a fraud. I am Blanket’s mother.”

Kelly Rutherford Allowed to Take Son to NYC

A judge has just ruled that Kelly Rutherford can take her son Hermes with her to New York while she films Gossip Girl.

Judge Michael I. Levanas told the actress she is free to leave on Sunday with her 2-year-old son, and that her estranged husband Daniel Giersch can go as well.

 
"This is not a difficult case to judge.  I’ve got two great parents," Lavanas said.  "I’m only concerned with what is in the best interest of Hermes.  The only plan that does not harm Hermes is the one that lets the child see both parents every single day.  The father said, ‘I can be in New York with the child’.  I applaud you."

Today was day three spent in court for Rutherford and Giersch. The Gossip Girl actress, who filed divorce papers on Dec. 30 and is pregnant with her and Giersch’s second child, has been involved in a bitter custody battle over their older son.

"I"m happy,"  Kelly tells OK!  "I think the judge made a good decision.  Now both of us will be with Hermes and there is much less stress for me, considering I’m pregnant."  

Giersch was awarded two overnight visits per week for the month of February and three per week for March. They all need to come back to L.A. for a minimum of four days, at least twice. During the L.A. stays, Hermes will alternate between the two parents.

The judge also ruled 2-year-old Hermes will bounce between NYC and L.A. for the next two months while the feuding couple tries to hash out a long-term custody arrangement.

Kelly Rutherford & Hubby Duke it Out in Court

From her pregnant cupcake cravings to his eyebrow waxings, Kelly Rutherford and estranged husband Daniel Giersch left nothing out on Thursday when each arrived at a Santa Monica court to testify over the custody of their 2-year-old son, Hermes.

Rutherford and Giersch spent two hours before judge Michael I. Levanas, dueling it out over whether Rutherford should be able to take Hermes to New York with her when shooting resumes on her hit show Gossip Girl on Jan. 27.

Giersch told the judge, "Being in New York, it is very stressful for our son. Whenever we are in New York, we are going 24 hours a day. It is always–this car, that car there, paparazzi here, photo shoots there…I have always been opposed to staying in New York. It is not in Hermes’ best interest."

Kelly, who yesterday arrived at court wearing jeans and a casual top, was decked out in conservative black slacks and a cashmere sweater when she took the stand on Thursday.

She told the court, "In previous statements Daniel has said that I was always off getting manicures and pedicures and whatnot. Well, he was doing the same thing, including getting his eyebrows waxed!"

Later, outside the courtroom, Kelly told OK!, "I want what’s best for our son. I want what’s best for the family. Being a mom now at 40 is a little tough but I’m doing well."

Rutherford is currently 4 months pregnant with Giersch’s second child. When asked if she had any cravings, she confessed, "cupcakes" and "Chinese food."

The warring parties will be back before the judge tomorrow.

Bizarre Allegations in Stone Custody Case

In the latest news in Sharon Stone’s ongoing battle for physical custody of her 8-year-old son Roan, whom she adopted with her ex-husband Phil Bronstein, court papers obtained by Extra reveal details of a tentative decision int he case.

 

According to the documents, Roan’s main residence will be Phil’s home, and Sharon will have visitation rights one weekend a month. Roan will also spend Christmas Eve and Christmas Day with his mother, and there are arrangements for custody of Roan on major holidays and during summer breaks.

 

There are also bizarre glimpses into requests made by Sharon concerning Roan in the Tentative Statement of Decision documents, according to TMZ.

 

"Mother appears to overreact to many medical issues involving Roan," the documents reveal. The judge also says he thinks Sharon believed Roan had a spinal condition,  "there was no evidence to support this allegation."

Even weirder?

 

"Another example of an overreaction is that Mother suggested that Roan should have Botox injections in his feet to resolve a problem he had with foot odor," the documents state. "As Father appropriately noted, the simple and common sense approach of making sure Roan wore socks with his shoes and used foot deodorant corrected the odor problem without the need for any invasive procedure on this young child."

 

Sharon lost joint physical custody of her son last week, after pleading with the court to let her retain joint legal and physical custody with her ex. However Sept. 12 court hearing documents state that Sharon "had failed to meet her burden of proof and [the court]" and they denied the "Respondent’s [Sharon's] request for modification of custody."

Sharon and Phil were married in 1998 and adopted Roan, who was born in 2000, before divorcing in 2004. Sharon is also mother to adopted children Laird Vonne Stone and Quinn Kelly. 

Britney Finds Calm in Cabo

Splashing in a pool and dancing with one of her bodyguards, Britney Spears looked happier and healthier than she has in years as she showed the world that she has her killer bikini body back.

The occasion was a weekend getaway vacation to Los Cabos, Mexico, organized by Palms Casino owner and good family friend George Maloof, who intended to help Britney relax after finalizing her hard-fought custody battle against her ex-husband Kevin Federline.

Britney, 26, lost that war. On July 25, Los Angeles County Superior Court Commissioner Scott Gordon signed off on an agreement giving Kevin, 30, sole legal and physical custody of their sons, Jayden James, 22 months, and Sean Preston, who turns 3 on Sept. 14.

Britney is allowed supervised visitation three times a week, including one overnight. Still, just having the custody battle over was a relief for Britney, whose focus now is staying fit (she eats five small protein-packed meals a day and works out rigorously), getting her career back on track and, most important, being a great mom to her little boys.

"Britney had an overnight visit with Jayden and Preston before leaving for Mexico," a source tells OK!. "They had just been picked up to go back to Kevin’s on Saturday morning when she left for the airport. Britney was in great spirits when she got on the plane."

Britney & Justin: Making Music Again!

Former flames Britney Spears and Justin Timberlake are set to record a duet on her new album, OK! can exclusively reveal. The song, written by Justin, will be laid down with the help of his super-producer pal Timbaland and will be the first single released.

"Justin has been a huge supporter of Britney at the label," a source at Jive Records tells OK!.

The exciting news comes at the heels of another major event in Britney’s life.  On July 17, OK! was the first to report that singer had given up her fight to regain custody of her sons from ex-husband Kevin Federline

He has had sole legal and physical custody of Sean Preston, who turns 3 on Sept. 14, and Jayden James, 22 months, since last October, and that status will remain in place for the foreseeable future.

"It was a win-win for all sides," the 26-year-old singer’s attorney Laura Wasser tells OK!. "For Britney, it was always about getting more time with the boys, and she achieved that."

 

Britney now has her sons two days a week for nine hours each visit, plus one 24-hour visit each week, Wasser reveals. If all goes well, there is a plan to expand another of those day visits into a second overnighter in two months. Those visits are still restricted to Britney’s Studio City, Calif., home, however, and must be supervised.

"The protections that were in place for the boys during visits remain exactly the same as when the temporary orders were in place," Kevin’s attorney Mark Vincent Kaplan tells OK!.

So why did Brit relinquish her battle to regain custody?

She had no choice, an insider tells OK!. "As long as her father is in place as her conservator, she is not getting custody back. Legally, she is essentially a child with no ability to make decisions for herself. No court would give custody to a parent who is under a conservator."

Denise Denied Emergency Order Against Charlie

For the second time in three days, Denise Richards was denied an emergency order against ex-husband Charlie Sheen that would have blocked his access to their two daughters.

"The court commissioner did not find any emergency to justify changes to the current custodial arrangement," the actor’s rep tells OK! in a statement.

Claiming there were "serious issues" at Charlie’s home that would harm daughters Sam, 4, and Lola, 3, Denise filed a request for an emergency restriction order against the star on Thursday, which was ultimately not granted by the sit-in judge.

Her attorney, Neal Hersh, announced intentions to re-file on Monday with their regular judge, who did not see just cause for the order.

"Charlie was very happy with the court commissioner only granting the innocuous portions of what Denise was asking for, and denied everything else," the Emmy nominee’s rep adds. "This is the second time in three days that Denise Richards asked two different judges to modify the custodial arrangements for Charlie Sheen, and on both occasions she lost. Charlie Sheen only wants what is best for his young children.

The whole ordeal, the Sheen camp believes, is a ploy to generate buzz for the actress’ E! reality show, Denise Richards: It’s Complicated.

"It is unfortunate that Denise Richards and her attorney are trying to create a media circus to help her promote her television series."

OK! Exclusive: Britney Ends Fight to Win Back Custody

In a shocking new development, OK! has learned exclusively that Britney Spears has ended her battle to win back custody of her children, Sean Preston and Jayden James, from ex-husband Kevin Federline.

In an exclusive interview with OK!, Kevin’s attorney Mark Vincent Kaplan says both Britney and Kevin reached and signed off on a settlement in their custody case today.

Kaplan tells OK!, "At about 8 p.m. PT, a final settlement in the Kevin Federline-Britney Spears custody case was signed. All parties have agreed to the following: Kevin will retain sole legal and physical custody of Sean Preston and Jayden James. Britney will continue to have visitation rights which may increase over time. The agreement will be presented to the court in the morning for approval by the commissioner."

Kaplan adds, "Kevin is ecstatic and the boys are thriving."

Britney, who remains under the legal conservatorship of her father Jamie Spears, lost custody of her sons to Kevin last October. At the time she had visitation privileges but they were severely restricted following her January hospitalization for psychiatric evaluation.

She currently has monitored visitation with her sons two days a week and one overnight.

Marriage Not Completely Ruled Out for Christie Brinkley

After a grueling trial that resulted in a settlement with estranged husband Peter Cook, four-times married Christie Brinkley vowed never to walk down the aisle again.

“Getting married again would not be an intelligent thing to do," she said, but friends of the "Uptown Girl" feel differently.

“Like every woman who’s had her heart broken, right now she thinks she will be single for the rest of her life, but she also said that after her divorce from Billy Joel!" the pal tells OK!.

While on the stand, Christie — whom a court shrink says has men issues and needs therapy — announced that she was currently single and wouldn’t dare think to bring a new man into the lives of her children, Jack, 13, and Sailor, 10, during this time.

But, “when she least expects it, she will find someone special who deserves to be with her," the friend believes.

And who might that lucky man be? “She doesn’t have a physical type, but her next man must adore her kids as much as they adore her.”
